111.000 PRIVATE SWIMMING POOLS* Ord. No. 25 Adopted: April 2, 1973

An ordinance to control the construction and maintenance of
private swimming pools put in the city limits.
THE CITY OF READING ORDAINS THAT:
111.001 Definition.
Sec. 1. For the purposes of this ordinance, a swimming pool
shall be defined as an artificial body of water contained in a
permanent or semipermanent container used by one or more persons
primarily for the purpose of swimming, recreational bathing or
wading.
111.002 Permit for construction.
Sec. 2. Prior to the beginning of any digging or other
construction of a swimming pool which will have a depth at any
point of over 30 inches, the owner of the land upon which the
pool is to be constructed shall obtain from the City Council
through the City Clerk's office a permit for said construction.
111.003 Fence.
Sec. 3. Any swimming pool constructed and maintained within
the city limits having a depth of over 30 inches shall be
surrounded by a sturdy fence of at least 4 feet. The property
owner upon whose land such pool is constructed and maintained
shall be responsible for the construction and maintenance of said
fence. The failure to provide such a fence shall constitute a
misdemeanor.
111.004 Noise control.
Sec. 4. The occupants of land upon which a pool is
constructed and maintained shall be responsible for maintaining a
reasonable level of noise in the area around the pool. Specific
reference with regard to unreasonable noise shall be made to
Ordinance No. 24, Subsection 9 [see 72.001(A)(9)].
Effective date. This Ordinance to take effect 10 days after adoption by the City Council.
